4. What is the warranty standard for Cotest products?
Cotest, Inc. ("Cotest ") warrants that the newly manufactured equipment ("Equipment") will fully comply with the applicable published specifications ("Specifications") delivered with the Equipment and updated by Cotest within one year and will be free from defects in workmanship and materials. Some devices may contain remanufactured parts that perform equivalent to new equipment, and such equipment will be warranted as new equipment. We do not guarantee the operation of the equipment will be uninterrupted or error-free. The warranty period for this device begins on (1) the date the device is shipped (if not installed by Cotest) or (2) the date the device is installed (if installed by Cotest). Device installation occurs upon successful completion of our installation program, proving that the device can do useful work [For example, completing the Standard Operating Verification Procedure, Interconnect Verification Procedure, or other Standard Diagnostic of Cotest is updated from time to time at the sole discretion of Cotest]. Unless notified by Customer to us, it shall be deemed to have occurred no later than 21 days after shipment of the Equipment. During the warranty period of the equipment, Cotest will provide buyer with free service, adjustment or replacement of any non-conforming parts returned under this equipment warranty.
For Cotest’s equipment, on-site repairs limited to repairing, adjusting or replacing parts will be performed within one year of the start of the equipment warranty at no additional cost to the customer.
This equipment warranty applies only to the normal use of the equipment. If Cotest determines that the defect or non-conformity of the equipment is caused by the customer's negligence, misuse or accident, the warranty is void; including but not limited to the use of parts obtained from third parties; or unauthorized repair, alteration or installation of the equipment. This equipment warranty does not apply to consumables (e.g., needle and probe tips) or mechanical parts of the device that are not in normal use. Customer's claim and the right to pursue Cotest is limited to the repair or replacement of defective or nonconforming equipment and parts, or, if repair or replacement cannot be completed, direct damages shall not exceed the price paid by Customer for the purchase of the product from Cotest.
Cotest guarantees that any services provided by us (the "Services") will be performed in a good and skillful manner ("Service Guarantee").
The warranty period and title contained herein are non-transferable.
All software warranties are set forth in the software license agreement for Cotest, if applicable.
The above warranty clauses are exclusive by default and must be supplemented or declared in writing if otherwise agreed in the commercial contract.
